These terms are the agreement between you and Legend Games LLC, the publisher and operator of XETODUS. By creating an account or playing, you accept them. If you do not agree, please do not use the game.

1. Who can play

You must be at least 13 years old, or the minimum age for consenting to online services in your country if that is higher. If you are under 18 (or the age of majority where you live), a parent or guardian must agree to these terms for you and is responsible for your purchases. You may not play if we have previously banned you.

2. Your account

• Give accurate information and keep your email address current. One person owns an account; do not share, sell, rent or transfer it.
• Keep your password, two-factor codes and recovery codes secret. You are responsible for what happens under your account; tell us at [email protected] if you think someone else has access.
• Usernames and pilot names must follow the code of conduct. We may change a name that does not.

3. Code of conduct

XETODUS is a competitive online world; ambushes, piracy and rivalry inside the game's rules are part of it. What is not allowed:

• Cheating: bots, macros that play for you, modified clients, exploiting bugs, or tampering with the game's network traffic or servers.
• Real-money trading: buying or selling accounts, credits, items, ships or services for money or anything outside the game.
• Harassment, hate speech, threats, sexual content involving minors, doxxing or sharing others' personal data, and spam.
• Impersonating staff, scamming for account credentials, or anything illegal.

Report problems in game or at [email protected]. While we review an account for possible cheating, automated checks may temporarily reduce the in-game rewards it earns; sanctions are decided by our staff, and you can ask us to review any measure (Privacy Policy, section 5b). We may warn, mute, suspend or ban accounts, remove names, items or currency obtained by breaking these rules, and reverse transactions. Serious or repeated breaches lead to a permanent ban without refund, except where the law requires one.

4. Virtual items and currencies

• Credits, items, ships, colonies and other in-game content, and Aether, are a limited, personal, revocable license to use them in the game. They have no cash value, are not your property, cannot be redeemed for money and cannot be exchanged outside the game.
• Aether is account-bound: it cannot be transferred to another player or turned into credits or items.
• We may change, rebalance, add or remove game features, items, prices in game currency and rules to keep the game fair and working. We will try to give notice of major changes.

5. Vanguard Charter subscription

• The Vanguard Charter is an optional subscription, currently $4.99 per month or $49.99 per year where the yearly plan is offered, plus applicable tax, billed by our payment processor Stripe.
• It renews automatically at the end of each billing period until you cancel. You can cancel any time with Manage subscription in the game; your perks continue until the end of the period you already paid for, then stop.
• If a payment fails, perks may continue for a short grace period while Stripe retries, then end.
• We may change the price or the perks. We will tell you at least 30 days before a price change applies to you, and you can cancel before it does. Taxes may change as the law requires.
• When the Charter ends nothing you earned in play is taken away; pilots beyond the free slots wait in storage until you return.

6. Aether purchases

Aether packs are one-time purchases of account-bound Aether, delivered to your account immediately after payment. Aether is spent on cosmetic liveries and Charter time.

7. Refunds and withdrawal

If something went wrong with a charge, contact us within 14 days and we'll make it right. Players in the EU and UK can withdraw from a new subscription within 14 days of the first payment for a refund of the unused part. Aether is delivered immediately. Where you expressly agree at checkout to immediate delivery and acknowledge that you lose the right of withdrawal, that right ends on delivery; otherwise EU and UK players can withdraw from an Aether purchase within 14 days for the Aether they have not spent. Details are in our Refund Policy. Nothing in these terms limits refund rights you have under the law of your country.

7a. Recruit a Wingmate referral program

• Players can invite others with a personal referral link. A new player is credited to the link they used when their account is created, within 30 days of opening it. Credit is given once and cannot be added or changed afterwards, except by our staff.
• Rewards are earned only when the recruited player reaches milestones through real play (for example a verified email, Flight School, pilot levels and hours played across several days) or pays for the Vanguard Charter. Signing up alone earns nothing. The current milestones and rewards are shown in the game.
• Rewards are cosmetic items, account-bound Aether and Vanguard Charter time. They cannot be traded, sold or exchanged for credits, items, money or anything else. Each player can receive at most 2,500 Aether and 180 days of Charter time from the program in any 365 days; cosmetics are granted once.
• Rewards for a Charter payment are paid 14 days after that payment. If the payment is refunded or charged back, the reward is reversed, including Charter time and cosmetics it granted.
• Recruiting yourself or your own other accounts, sharing devices, payment cards or connections with a recruit to collect rewards, buying or selling referrals, spam, misleading offers, fake reviews and paid advertising that bids on the XETODUS name are not allowed. We check referrals as described in the Privacy Policy and may hold a reward for review, refuse it or reverse it. Abuse voids all related rewards and may lead to action under section 3.
• We may change the milestones, rewards and caps, or end the program, at any time. Rewards already paid in line with these terms stay yours.

8. Content and intellectual property

The game, its software, art, 3D models, textures, sound, music, names and logos belong to Legend Games LLC or its licensors and are protected by copyright and other laws. We give you a limited, personal, non-exclusive, non-transferable and revocable license to use the game client to play XETODUS under these terms. Nothing else is transferred to you.

You may take screenshots and videos of your own play and share them, including monetized streams, as long as you do not suggest we endorse you.

Except where the law gives you a right that cannot be waived, you may not:

• copy, decompile, disassemble, deobfuscate or otherwise reverse engineer the game client, its network protocol or our servers, or get around the measures that protect them;
• extract, rip, bulk download, convert or capture the models, textures, sound, music or other assets of the game from its files, its memory or its network traffic (other than the screenshots and videos allowed above);
• copy, publish, share, sell, license or otherwise redistribute the client, its code or any of its assets, in whole or in part, or use them in another game, product, service or data set (including for training AI models);
• host, mirror or embed the game or its files anywhere else, or build unofficial clients, servers or competing services from them.

Doing so also breaks the code of conduct (section 3) and may lead to a ban, and we may take legal action to protect our rights, including takedown notices. The game files carry identifying marks so copies can be traced. Anything you post in chat or name in game you license to us to display and operate the game.

9. Availability and changes

XETODUS is an online service that we keep developing. It may be unavailable during maintenance or outages, and features may change or be retired. We may end the game; if we do we will give at least 30 days' notice and refund any unused prepaid subscription time.

10. Disclaimers

To the extent the law allows, the game is provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose or that it will be uninterrupted or error-free. Some countries do not allow these exclusions, so they may not apply to you.

11. Limitation of liability

To the extent the law allows, Legend Games LLC is not liable for indirect, incidental, special, consequential or punitive damages, or loss of data, profits or virtual items, and our total liability to you for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or US $50. Nothing in these terms excludes liability that cannot be excluded by law, such as for death or personal injury caused by negligence or for fraud, and consumers in the EU and UK keep their statutory rights.

12. Ending the agreement

You can stop playing and delete your account at any time in Account settings. We may suspend or end your account for breaking these terms, as described in section 3, or if we are required to by law.

13. Law and disputes

These terms are governed by the laws of the United States and of the state in which Legend Games LLC is organized, without regard to conflict-of-law rules. If you are a consumer in the EU, UK or another country whose law gives you the right to bring claims at home or under your local law, you keep that right. Please contact us first; most problems are solved quickly by email.

14. Changes to these terms

We may update these terms. We will show the date at the top and tell you in the game or by email before significant changes take effect. If you keep playing after that, the new terms apply; if you do not agree, you can close your account.
